1938-04-25 John Henry Lewis w co 4 (15) Emilio Martinez, The Auditorium, Minneapolis, Minnesota, USA - NY/NBA/GB. Referee: Britt Gorman. Jabbing and moving with great skill, Lewis (174¾) hurt Martinez (174) badly in the opening session before scoring at will with telling lefts and rights in the second and third rounds. In the fourth, Lewis, having set Martinez up with the left, caught him flush with a right to the jaw, a punch that saw the challenger counted out on the 0.54 mark.
On 27 July, Lewis forfeited NYSAC recognition under the six-monthly defence ruling when refusing to fight in the ‘Empire City’ and was given until the end of October to defend in New York. With this statement, the NYSAC named Tiger Jack Fox, Gus Lesnevich, Melio Bettina and Al Gainer, who was already contracted to challenge Lewis for the title, as the four outstanding contenders and the men they would be selecting to contest the vacant title, if need be. This action was followed by Lewis taking the NYSAC to the Supreme Court and resulted in him being granted the right to appeal against the NYSAC’s decision.
