In a nationally televised bout on Fox Sports broadcast from Pechanga Hotel and Casino in Temecula, California, a close bout between heavyweight contenders James Toney and Hasim Rahman ended in controversy. An accidental clash of heads in round three produced a cut over the left eye of Rahman, and caused blood to stream into his left eye. Ringside physician Dr. Paul Wallace deemed the cut too severe for Rahman to continue, but when he also asked Rahman and his corner if he could continue, Rahman stated "No, I can't see out of my left eye," and Rahman's corner stated as well that Rahman could not continue, causing the bout to be stopped. As Rahman stated he could not continue several times, without his cut left eye being evaluated as meeting the criterion for a no-contest ruling first, under California rules the fight was ruled a TKO3 win for Toney. Rahman stated after the bout that he thought the fight would be ruled a no-contest due to the headbutt causing the left eye cut. Rahman's corner stated after the bout was ruled a TKO instead of a no-contest that they would appeal the outcome to the California State Athletic Commission. After a thorough rereview of the bout, on July 28, 2008, the outcome was reversed and the fight was declared a no-contest by the California State Athletic Commission,due to the accidental headbutt which caused a stoppage of the contest.

After three rounds, Toney was ahead on 29-28 on two of the judges cards while Rahman was ahead, 29-28 on the third card.
