Australian Browne has vehemently protested his innocence since testing positive for Clenbuterol on the back of his March triumph over Ruslan Chagaev in Grozny and drafted in Margules to take his case.
‘Big Daddy’ has always claimed that a steak ingested during a pre-fight meal was the cause of the substance showing up in his system in a test taken in the wake of his victory. Prior to the fight, which was his first world title challenge, Browne had tested negative upon arriving in Chechnya five days earlier meaning the drug found its way into his body between March 1 and fight night.
Speaking on Wednesday, Margules also stated that a protest to the original ban would not be forthcoming.
“I will not be asking the World Boxing Association to look into it and there's no plan for an appeal,” Margules exclusively told World Boxing News.
“We will be going to court for a lawsuit against the WBA,” he added.
Apart from a statement of denial, Browne has kept quiet on the matter to allow his team and legal representatives to take the reins despite being unable to return to the ring until September, at the earliest.
The 37 year-old has had to watch on as the WBA give Chagaev back his old belt and order a mandatory fight against Fres Oquendo in the next few months.
A similar case to undefeated puncher hit the headlines recently when WBC super featherweight champion was immediately cleared by President Mauricio Sulaiman of any wrongdoing, although Browne is facing a longer fight to clear his name as Margules plots the next move.

The obvious question is, how long is this legal process likely to take? I guess if Browne was to come away with the title it would be worth it though.

This is just grandstanding.
lol at trying to say what the WBC did is precedent. The WBC and its long history of favoring Mexico based fighters isn't going to help Browne with the WBA.
WBA isn't afraid of being drug into court and once in court Chagaev's boogey man excuse has no chance.
Fres Oquendo had to drag them into court to get his contractually obliged rematch ffs.
On top of that giving the belt back to the guy who tested positive for a banned substance would almost certainly bring a lawsuit from the camp whose fighter did not fail any drug tests.
Ultimately it is up to the fighter to keep banned substances out of his system.
Knowledge and intent are irrelevant.
WBA followed its rules and actually went easy on Browne.
If you're the WBA you feel very good about your chances of beating Browne in court and in the unlikely event they lose they won't have to deal with a lawsuit from the Chagaev side. I could be wrong but I doubt the Chagaev side would sue the WBA for following a court order.

I doubt Browne's team will try to get the belt back in court, I believe it would be to get him a fight Vs the winner of Fres Vs Chagaev.

It seems that boxers are treated more leniently than athletes in other sports. It's still a provisional automatic 2 year ban even for accidentally ingesting prohibited substances, and they're not punching someone in the face. Christine Ohuruogu and Rio Ferdinand got a 9 month ban JUST for missing 3 tests.
It seems there is a lack of consistency in boxing in comparison with other sports.

I doubt we'll see Chagaev in the ring again. I'm sure he indicated he was retiring after Brrowne knocked him out, and getting the title handed back wasn't enough to change his mind.
