What is Hearn's cause of action if he sues the Board? From where I'm sitting, there's none whatsoever. Just because Benn didn't fail a UKAD test does not mean the Board had no grounds to pull the fight. The only area that is grey is whether the Board knew about the failure two weeks ago - some posters here seem to be taking the words of EH and KS on that as gospel, whereas that needs to be proven if it is relevant in any legal action. Even if that is proven, Hearn would still need to show a cause of action - possibly negligence for not acting more quickly to cancel? It all seems pretty weak stuff.

OK, no takers for this question so far. The EH interview above talks as if Conor Benn is a BBBofC licence holder. Wonder if he has been removed from the website so he does not appear as either suspended or not suspended (in case either position creates a problem for the BBBofC). All a bit curious.

And as for EH saying that they cannot suspend him because the BBBofC does not recognise VADA, they potentially can, by either of two other routes:

- Reg 25.1.1(c) says that misconduct includes "any failure to honour any contractual obligation". If the need to pass VADA testing has been built into the contract, then failing the test would appear to breach that contractual obligation, so misconduct. However, have the BBBofC seen the contract?

- Under Reg 25.1.1, misconduct means "conduct detrimental to the interests of boxing or the public interest". As the Board have already said it is not in the public interest for the contest to go ahead, that would appear to indicate that Benn has done something that fits within this definition.

So they have routes to suspend if they are minded to do so.

UKAD didn't involve VADA though didn't they,who was that again? i said yesterday that technically Hearn and Benn were correct in regards to Benn being allowed to fight, morally it was wrong though and unlike a lot of people I expected better from Eddie Hearn, drug cheats need banned for life and could maybe partake in fighting other cheats, I'd watch tbh but keep them away from honest athletes

It’s on the UKAD list too. They just didn’t have a positive test for it because it sounds like it was out of his system when they did test him.

From what I’ve read about it it’s not been used to give him abnormal testosterone levels. It’s probably been used to give him a normal level due to a likely depletion in testosterone following a cycle of goodies.

Billy Joe vs Andrade. The contract was VADA testing which is what the state in the US used. The WBO stripped Billy Joe because the fight couldn’t take place there. Interestingly Billy Joe wasn’t banned by the BBBC because they didn’t find a positive test and the substance isn’t on their banned list (which is in-line with WADA).

Slightly different scenario because I’d imagine that if that fight was due to take place in the U.K. it would have happened.

He wasn’t banned by the BBBC and fought, in the U.K., 2 months later. There is a subtle difference though in that the stuff Billy Joe popped hot for isn’t banned by UKAD/WADA but it is banned, as Eddie says, by the gold standard VADA.

The stuff Benn had in him is banned by everyone!

The annoying thing was thought that talking in general terms about doping earlier in the podcast Matt made the point that the B sample very rarely, if not never. produces a negative result once the A sample tests positive.

Hiding behind the innocent til proven guilty B sample argument is disingenuous. The B sample test is akin to a convicted felon appealing a conviction for a crime for which he’s already been found guilty

As the dust starts to settle, I wonder if it will dawn on Eddie how badly he's played this. He is not stupid. This has transcended boxing and he's not going to come out of it looking good. To me, he's forfeit any moral high ground for the rest of his career when it comes to drugs in boxing. I think he'll regret how he's played this one out and his dazn paymasters can't be happy at his very public handling of it all. He's more or less the face of dazn even though he's not part of the organisation. It does not look good.
