Just out of interest, anybody know much about this?

A flat mate of 2 months has just given notice of four weeks that she is moving out. She originally paid four weeks deposit. She is now refusing to pay her final months rent and is saying to use her deposit for it even though doing this leaves me exposed for outstanding bills and potential damages which may arise when it's time for her to move. Rental in the apartment was agreed verbally with nothing in writing (I've always done it that way without problems but never again!). What do you guys think?

striclyl speaking she should pay you rent she has to have your agreement to use the deposit as rent.

if i were you mate, i would say ok fair enough but any damage i want reimbursing.

at least that is a comprimise that should suit both parties.

Without it in writing I don't think you have many options mate. She's kind of got you in a corner here so the best bet would be to rig up one of those webcams in her shower and post a link to everyone on the boards.

John you're mad going with all this "verbal agreement" stuff. I'd count myself lucky if I were you and get something simple draughted up for the next one. Too many piss takers out there.

The fact she hasn't signed a tenancy agreement, means you don't have a leg to stand on.

However, if she is a lodger in the place and you live there, then in fact she doesn't have any rights, you can simply wreak your revenge by telling her to fornicate off and flinging all her shit into the street before the month is up.

Tenants who share a house with the owner/occupier, don't have any recompense in law, as they stay there at the discretion of the landlord.

So in this case, if she is refusing to pay rent and being a cow, then tell her to fornicate off or you are calling the police...then see if she wants to be such a stubborn twat.

No, she's an Aussie. She's moving out to get somewhere cheaper in Clapham in a house share with Aussie friends. It's not my place, I took it on as a one year lease and needed her out anyway at the end of the month as I've a mate from back home moving over here who I'm getting in. I have to tell her that she either leaves a deposit until the end or else she has to move out with immediate effect.

Plus I also managed to get this definition of a rental security deposit:

A security deposit is not the same as rent. It is money that actually belongs to the tenant but is held by the landlord for tenant-caused damages and sometimes past-due rent. Without the agreement of the landlord, a security deposit may not legally be used as the last month's rent.
