O/T Anyone know anything about Divorce/ House Share Law

Hi appreciate anyone advice on this. Broke up with my gf last year. We bought a house together in 2002 before the prices went up. I put down 7k she put down 1k, i paid the mortgage for a year from my account, she paid from a year from hers and I paid in cash for the other 18months (stupidly not keeping receipts). Anyway split up a year ago and now shes saying shes going to a solicitor to get her half (after not been happy with my offer), so anyone know the deal here? Thanks for any help

my mate has just gone through the same thing, he injected a lot more cash but they ended up on a 50 / 50 split.

I suspect if you bought the house 'together' as you say, she'll get half.

Very sorry to here it... I think she has a case though in the eyes of the law (shitty law I know)... From what I understand it, I am sure if you live with your partner for two years - the same laws apply as a married couple.
If the house if officially in a joint name and its been a partnership thats lasted over two years - I think she'll get the half.
Still though worth checking it over with someone more qualified than me.

Point for the future Gents.
A mate of mine is going through a shitty break up. He and his bird had a "joint" mortgage, for which he paid everything. She now wants half.
However the sneaky bastard never let her sign the actual mortgage documents. He gave her photocopies and never officially had her on the mortgage. She's getting fcuk all. Serve the fetid whore right too.

I'm not sure if this is the case - I lived with a girl for over 2 years and when we split up she tried to get half of my house (which I had just bought and we didn;t even live in!), but failed. From what I remember reading if the partner can prove that they kept the upkeep of the property then they are intitled to part of it. I remember an example of "commonlaw wife" being Jerry Hall - something about she tried and failed. This was 5 years ago and my memory is a bit hazey and the law might have changed - so don;t take this as gospel!
Probably your best best is to go to a solisitor that has a free 30 minute session and specialize in breakups.

That is totally class!

Although she should have twigged not being on the mortgage statements!

I've also been told that you can put a house into a limited company and be the owner of that then you can get out of giving half in a split. But don't know this for sure so don;'t try it without legal advice!

Again, I’m no expert, but the fact you paid cash for 18 months and don’t have receipts is a point against you if it went to court. She might just lie and say she actually paid half of the cash too, and you’d have trouble disproving that.
I’ve just bought a house with my GF, and on the mortgage we are listed at “joint tenants in common” – meaning we own 50% shares in the property respectively. Whoever actually pays the mortgage is incidental (I pay a bit more as I earn more), as most mortgages are held against both names, so you’re both liable for the repayments on it. However you privately choose to repay it is your business, but the repayments and the asset itself are jointly owned.
So in a split.... jointly shared....

How about me as i am thinking of trading her in for a new younger model.
I bought my house before we were married, i put in all the money to buy it, My parents also put in the same amount that i put in.
The mortgage is in my name and i pay the mortgage payments. Im self employed & my home is also my Bussiness. We do not have any children.
She has not gave me one penny, infact i paid her previous loans off & pay her credit card payments.
Two of Her friends have just had a divorce and she has it in her head that if we were, she would get half
I was thinking more like i might let her have the sofa as i need a new one!

I know of a few people who have used a 'tenants in common' contract. It basically states how much money each person has put into the property including deposit, legal fees etc. So if you paid all of the £50,000 deposit and then split up, you get that back and then you would split any equity that the house may have 50/50.
I am in the process of doing something similar and will not be going ahead until all the paperwork is sorted. With the cost of buying a house these days you would have to be mad to not cover your back in these situations.
As harsh as it may sound, you just can't trust anyone when there is money invloved.
The solicitor advised me that I should keep a record of absolutely everything that I pay for in regards to the property.

Well just to update you she seems to be a bit more reasonable today and she prides herself on honesty and doesn't really want to go through the courts. Been researching it and payments you make are taken into consideration if it goes through the courts.
She wants her money and isn't prepared to do any work to sell the house so basically she wants me to buy her out ideally meaning I have some leverage to play with. I offered her a pretty low deal as a start point to negotiations and it pissed her off (alongside the fact I accidently left photos of the girl I cheated on her with around and when I came to see them they were turned upside down) instead of provoking negotiations. Hopefully everyone can be winner and we'll both be happy. As were mediating now it sort of makes me miss her

UYsual story, they do the housekeeping and their bit of hoovering compensates for your hard-earned. She will get 50% so don't waste any time on lawyers!
Alot to be said for being a poof these days, financially speaking!

Yes, but the sex life would be quite a price to pay, I think I would rather take a shafting financially than play catcher to some muscle mary's pitcher any day. One's bank balance would recover, but one's dignity is another matter entirely.
