Legal Standing On Refunds For Khan v Barrera
Legal Standing On Refunds For Khan v Barrera
Seeing as at least 2 lawyers post on here, I would like free legal advice. 8)
Based on the assumption that the tickets for this event will have "Khan v Barrera" on them (as per the seetickets website has indicated), what's the legal standing on getting a refund if Marco doesn't fight?

Re: Legal Standing On Refunds For Khan v Barrera
I would imagine the fight will sell out but i dont want barrera pulling out for what ever reason and ticket office saying you can't have a refund as nicky cook enzo macc are stilll on the bill.
Re: Legal Standing On Refunds For Khan v Barrera
Cheers Taf, I've taken screenshots of the website already along with URLs announcing the fight/press conference video. I'll make sure I order it on VISA too.
I'm due to get DNA samples of both fighters within the next two weeks. 8)

Surely, if ppl are already worrying - don't go, and don't buy a ticket. Just PPV it if you have to.

No chance of a refund, there will be the usual 'Bill subject to change' in the small print.
Its standard procedure so I think best bet is getting a walk up ticket!

Re: Legal Standing On Refunds For Khan v Barrera
I remember when Calzaghe was going to fight Magee in Belfast and the WBO scuppered it. The bill went ahead with Eamonn Magee, but they offered full refunds. A lot of people got the refund on an expensive ticket, bought a cheap one and sat in the original seat.

Buy on a credit card and if he pulls out, call the credit card company (use www.saynoto0870.com to find their geographic number if they have an 0870 number), demand a credit card charge back as you haven't received the service promised and this is in breach of the sale of goods act and trade descriptions. Credit cards act as insurance and its actually their money not yours that's being used. You'll probably get an instant refund, if the credit card gets difficult just keep playing hard ball until they do their job
Re: Legal Standing On Refunds For Khan v Barrera
I was pretty sure that the tickets always carry the disclaimer that the bout list is subject to change. I have just looked at my old Calzaghe Kessler ticket and that isn't there but there is no mention of Calzaghe or Kessler either, it's just World Championship Boxing.
So i expect that is his protection, you're paying for a night of WC boxing and as long as that is provided Frankie would maintain you have no claim.
I'm thinking that if at the point of purchase Ticketmaster specifies the name of the fighters rather than WC boxing you could maybe have a case against them for misselling.

Its a sorry state of affairs when we all think like this. Can't think why we've all got so little faith in FW

I'm not sure of this Credit Card Chargeback business. The merchant , in this case Ticketmaster or whoever, can dispute the chargeback and they would probably win- I think all they would have to prove is that they sold you the ticket and the event went ahead.
That said, I totally agree with the original post's sentiments. I'd like to go to See MAB V Khan. If that match doesn't happen, I'd probably not be interested in going.
I think we just have to gamble.

SN shows in the past, and if i remember correctly, the 6th December show with all the pull outs had 'World Championship Boxing' on the ticket.
So despite originally advertising Cook and Enzo Mac fighting for world titles, they could claim they still provided what was agreed between themselves and the consumer when we got Amir Khan fighting for the WBA International lightweight title.

What would happen is YOU dispute the charge and then the card company approaches TicketMaster or whoever took the harge, they then have to prove the order is valid.
Fwank will have a way of getting round it so I doubt you will get anything back.
SN have a clause as most people do about changing of the Bill etc!
Re: Legal Standing On Refunds For Khan v Barrera
On another note, prices vary for this from £40 for the upper tiers, £50 for some of the lower tier seats (and apparantly upper tier seats too), £100 for other lower tier seats (this is not base don how far back you are, rather the block),
Then its over £100 upwards for flat floor, up to £300 depending on the block.
I know of no other sport or pastime where prices vary by such ammounts for what is more-or-less the same view (give or take being a bit nearer, or perhaps a better angle.)
I understand higher tiers being cheaper, but its all this flat floor pricing that is just hard to figure out.
Also- I've just noticed- the cheaper lower tier tickets are blocks 105, 106, 107 etc, those that are furthest from the stage- although less of a disadvanatge with a central ring!

Got my ticket, a £57 one in the corner of the lower tier 6 rows up! I had a bad experince with flat floor, plus they can get fucked if they think I'm paying hundreds.

I've been a merchant and have a hard time with people who blatantly scam credit card chargebacks even when supplying a valid service.whicker wrote:I'm not sure of this Credit Card Chargeback business. If the event is advertised as an event with Barrera it is breaking certain statutary rights by not supplying that service, DISCLAIMER OR NOT. A disclaimer doesn't absolve a seller of their legal selling obligations.
Re: Legal Standing On Refunds For Khan v Barrera
Yeah, true- I have bought a ticket to see "Amir Khan V Marco Antonia Barrera" I'd expect I'd be well within my rights to demand money back if that service wasn't provided.Phenomenal-Nutrition wrote:whicker wrote:

I didn't realise tickets were being billed as that, it nearly always is "World Championship Boxing" nowadays.
