Read in the paper, that he is suing the BBBOC. As they failed to inform him that there was a problem wif his scans, prior to him fighting. This looks realy bad for, the board if this is the case. It was in the scottish Sunday Sun.

If they failed to inform him does that mean they had the information regarding the problem and failed to disclose it or that the "problem" wasn't picked up by the scan?
The board receive scan's that are performed from credible sources I.e hospitals and then they are compared to precvious scans of the boxer by a panel of medical experts to ascertain if there are any changes. To prove that the board didn't pick these up they would need an expert second opinion and have access to all previous scan results.
I would like to hear the full story on this one.

In my experience the board are very strict on scans, if anything too strict.

I'm not sure theres such a thing, if you look at the worst case scenarios for too-strict or not-enough: in one you have to go and get another job, in the other you could end up like McClellan or in a box. Anderson would have felt much worse if the board had stopped him taking those title fights, sounds like he is after a free lunch.

The guy aint fought for 5 years and then it was a shut out by McIntyre.
What's he gonna sue for ? it's not like a premier footballer with an intentional-foul career ending broken leg ?

If its proven that the he was unfit to box (say before the muttley fight for example, where he took some serious stick) but the board failed to notify him, he has a very good case. Would he have continued to box if he was informed of a change/irregularity? Sounds like he wasn't even given the choice (he wouldn't have been given one but he could have a second opinion etc).

Sounds like he has been on the phone to Injury Lawyers 4 U.
It appears that something was found on his brain scan, which stopped him boxing and they say he it could have been there a long time.
The chances of this going to court are zero. What's he going to sue them for? It can't be potential loss of earnings, because he is saying he shouldn't have been allowed in the ring in the first place to earn what money he did. And there is no proof that he suffered any injury in the ring that has stopped him doing anything else.

Considering todays "blame and claim" culture in the UK where you can sue for papercuts, in going toe nails, headaches and bad hair days I'd say there is a very strong and realistic chance of this going to court.gobbles wrote:

Whilst I agree that if someone didn't examine scans properly on behalf of the BBBoC then it needs investigating properly and an understanding why it happened.
If a boxer pays fees for licenses, sanctioning fees etc - then the BBBoC has a duty of care to him and if they failed then it could very well end up in court.
Although 'going to court' is normally a last resort and often the focus of the person is to get money out of someone and not to get a situation fixed for the good of the sport.
Like I said if Kevin was a high-flying world champ and they let his scans slide and he was routinely putting himself in grave danger then he has a cast iron case, but having been out the sport for years and not going beyond domestic level I think it wont be easy to prove what level of compensation (if any) he can claim.
Unfortunately that's life. Some may think he is well within their rights to challenge them, others might thing he is after a free lunch and lacks moral fibre.

There are people in this world that get rear-ended by another car and be absolutely fine; They exchange insurance details and move on with their day. They realise that a mistake occurred but nobody was harmed and that is that.
Unfortunately those without any morals get rear-ended at low speed - and despite being absolutely fine they roll out of their vehicle demanding a ambulance and a neck brace, whilst laying on the grass verge waiting for their stretcher, they wonder what they will spend their £4k compo on.
Thats why people always look down on these type of scenario whereby nobody is injured yet blame is kicked around.

If There's been a mistake and it's affected Kevins life and health then it is up to him to do the right thing for himself and his family.
There was a boxer from Doncaster who was very badly hurt in a bout; an immediate operation was needed and it was found that he had a portion of his skull thinner than it should've been. This boxer turned pro after the Michael Watson fight and injury and after the improved health checks/brain scan etc. The boxer could never box again and decided against making a claim against the board. He chose not to as he'd enjoyed his time boxing and it had been his free choice to box. He saw himself as fortunate.
Each of us is different and have different outlooks and pressures. Kevin ought not be swyed by what anyone else thinks.

not sure how it would play out in court. by getting in the ring to take punches to your own head, surely you are accepting the risk of death or serious injury, with or without brain scans?
