As I see it Damian has contracted the boxer on his show pretty similar to somebody being employed by a company so basically in law if anything happens to the employee whilst in the employ of the company the company has employers liability insurance to cover every eventuality if Damian hasn't got this insurance he will have serious problems but even if he has got insurance it will only pay out if all health and safety regulations have been strictly adhered to a signed disclaimer wouldn't stand up in court IMO even if Damian is running shows through a limited company he as a director would still be held personally responsible even if he wound the company up
If a disclaimer was a legal document there would be no need for any company in the uk to have employers liability insurance IMO

I have decided to comment on this to clear a few things up as someone who attended the event and knows personally many of the people involved having boxed on one of these shows myself previously.
The lad did not collapse in the ring as the article stated, although it was not long afterwards. and was a routine bout with no big punches landed etc with an EBA registered referee in charge.
As the person said who commented on the article it was initially thought he had an asthma attack, but the paramedics/ambulance crew who were already in attendance quickly realised this wasnt the case and he was taken to hospital, where he suffered kidney failure followed by a fatal heart attack the following day.
I spoke to the trainer of lance ( the lad who passed away) and he said the lad had an mri scan at the hospital and there did not appear to be any boxing related injuries whatsoever, and the trainer does not attribute boxing to his death, he said it could have happened on a jog the next day or driving to work maybe and also been taking something called t7 or something, off the internet as a suplement, which may have been a contribution to the cause.
They all had a medical and weigh in on the day although this will have been pretty basic, but again as the comment on the article said is there any pre fight medical that checks kidney condition that would have prevented this.
I do believe though that damian will have a lot of problems and will be struggling if it goes to court, although im hoping it doesnt come to that and the post mortem will reveal that damian wasnt to blame, as in fairness hes one of the best promoters on the circuit and if it can happen on his show then it can happen on anybody's show.
i dont believe any public liability insurance would protect the boxers anyway would it, surely that only covers spectators and such.
in fact ive literally just spoken to damians partner via text as i write this to say that its now on here, hes apparantly in a terrible state and is absolutely devastated by whats happened. hes pledged to donate the shows money to lance's family, hes not a well off guy and what hes giving will probably be the only money he even has (not that im suggesting that replaces a life sufficiently) and he has been contacted by the local newspaper today in which hes offered his sincere thoughts to the family.
Im gutted for damian of course, and im told the lad he boxed is also in a terribly upset state, but my foremost thoughts are with lance's family, who no matter what the cause of death turns out to be will be totally devastated.
Edit: also note this was actually a charity event and also dmian had already announced his intention to quit the circuit as he continues to train as a paramedic himself.

How many paramedics and ambulances are there at these unlicenced shows? Are the nearest hospitals advised from the promoter that there is a boxing event scheduled in their town, just to make sure they know and are aware if any casualty may occur

To be fair. Every unlicensed show I ever boxed on there were ambulance and medics on site.a hell of a lot of pro shows I boxed on we're no better in terms of medical teams on site.its very sad to hear a man has died.im sure Damien is all over the place.boxing at any level can be dangerous.this only brings this home. I hear its not a direct result of getting punched or thru medical negligence I hope that's the case. The only things certain in life are death and tax's. don't know why people think the standards are much better in the pros. They're not.

It is a tragic case, as he had a young daughter.
Details are always unclear at first, but already it would seem that whilst the boxing event might have been a trigger of his underlying health problems, the mounting medical evidence emerging would seem to suggest that the boxing event itself didn't actually caused him any harm.

Ive been to a lot of damians shows at the forum and met damian a good few times, His shows are always well ran, fights well matched and to my memory always have paramedics/st johns ambulance in attendance. He's a decent bloke and i hope nothing comes of this for him.

Yes must echo the sentiments of others regarding Damien - if it was anyone else I'd be skeptical but he's always being so fiercely proud of his boxing organisation we've had several friendly exchanges about our views on unlicensed boxing. I'd be certain he'd have everything in place properly. He does seem to do it for enjoyment and entertainment rather then to make coin.

I think maybe the blowback will be there will be more hoops to jump though for the promoter. It could see it truly turn "semi-pro"

I was due to box on the show in main event but this incident took place meaning it got halted.
Gloves used are 12oz.
The shows always run well and in terms of what happened - it was just a freak occurrence that could have happened on an amateur show or any other sport.
I'm from a amateur background and this won't put me off fighting on shows again, as always I ensure the person running the show has a good reputation before signing up to do so. Damien definitely fits this bill

as i said earlier unless damian has got employers liability insurance with boxing specified on it he could have serious problems you are right a waiver is not worth the paper its written on
I hope he and indeed the venue have got insurance other than public liability
its a terrible tragedy and my heart goes out to all concerned

Sad news for the lad, white collar boxing is something I have been interested in previously and nearly did it but my own laziness stopped me. We can probably all relate to a guy just wanting to get in there and give it a go, so it's really sad news.
I would never blame the promoter though, end of the day he is providing a show for these lads to fight on which should be viewed as a positive not a negative. I know we live in really OTT health and safety times but you can't take all the risk out of the sport all the time and I'm sure costs associated with having ambulance crews at each show would be incredibly high for a small show like that. Think about taking an ambulance crew off the road for 4-5 hours in terms of NHS costs, got to be a very expensive thing to do.
It's a tragedy and I feel for the lad's family and friends. The BBC have also reported that the Council and Nottinghamshire police will not be investigating as all the appropriate licenses were held.
Of course Damian is not yet out of the woods as the postmortem has to be conducted first to clarify a cause of death, but it does appear to have been completely unrelated to boxing and unlikely to have been detected even on a pro show from my information.
In response to your final question... i think BBBoC might appeal towards that direction but i dont believe it will happen, it would likely end up in a messy and expensive EU courts situation... unless of course the UK leaves the EU
Of course its still the lost life that is the first concern.

Can i just add that the article on the boxrec front page annoys me.
where it states BBBoC have strict rules about ambulances being ready and waiting on their shows.
ALL of Damians shows always also have this and that was the case in this tragic case too, but it implies that this isnt the case.
How do i know this ? i attend them all and have boxed on one.

There was no Ambulance there at all according to medics. How can the promoter be called a nice lad and safey consious? He should be jailed, no excuses whatsoever, it's a form of corparate manslaughter and serious negligence. Someone has died which is tragic so do not sugar coat the person responsible for falling in his moral duty.

I was there. there was 100% an ambulance already there and is at every event regardless of what hearsay you believe. The show i boxed on was delayed due to having to move the ambulance as someone had complained it didnt look nice having an ambulance parked outside, like it indicated there had been trouble.boxingchat wrote:There was no Ambulance there at all according to medics.
