Klitschko Sued by Brain-Damaged Magomed Abdusalamov

Wladimir Kilschko’s part in this whole mess pertains to his responsibility as the promoter of the event. He has already attempted to involve his insurance company, but they have stated that their policy contract expressly excludes injuries sustained during boxing matches. Injuries are a virtual guarantee.

Give Abdusalamov what belongs to him, the referee didn't stop the contest when it turned into an obvious brainkilling slaughter. He needs to get some payment for those injuries.

Every fighter knows the risk when stepping in the ring.
Klitschko holds no liability in my eyes.

Risks should be minimised by the promoter.
That isn't to say Klitschko is liable for anything in this case. Reasonable measures should be taken to protect fighters.

Promoters should buy insurance covering such instances. Of course, their pockets will suffer, but injured/damaged boxers will benefit.

Klitchkos are liable.

Hasn't Klitschko got a PHD? Wouldn't he have worked in tandem with experienced operatives? Wouldn't the commission have checked he held proper insurances?

If the ring collapsed then yes. But not via beating. Wouldn't the boxer have their own insurance for that?

Like a person isn't supposed to drive without insurance, a boxer shouldn't step into the ring without proper coverage. Whether it should be purchased by a boxer or a promoter, needs to be regulated. I would expect a promoter cover that.

The boxers are self employed. I would expect them to have their own insurance.

The boxers are self employed. I would expect them to have their own insurance.
Boxers sign contracts with promoters who pay them and cover some of expenses. Looks like employment to me.

Is there a claim that proper insurance wasn't held by K2?

If the promotion did everything they are legally supposed to I don't see how this doesn't get thrown out or is simply a waste of Magomed's families time & resources. From what I've read of this situation it sounds like if there is blame its the local commission. I imagine this decision might be based on the Klitchko's bank account than their actual level of guilt in this unfortunate situation.

Those reasonable measures are the same measures that were put in place for every other fight on the show.
Of course nobody wants to talk about that, it's only AFTER something happens that people want to get on their moral high horse and say everybody who has money owes a large portion or all of it to the willing participant who suffered an injury while taking part in a very dangerous activity.
It is completely unreasonable to think that grown men all over the world can train for this sport, step in the ring, hit each other in the head repeatedly and NEVER have anything like this happen.

As long as this sport exists a probability of zero is not achievable.
The only way to reduce the probability of these type events to zero is to not allow the sport to exist.

It's not surprising that some insurance companies won't cover injuries suffered in a boxing ring.
Apparently, many of them won't provide insurance for sky-divers either. NASCAR had to start putting restrictor plates on the cars at Talledega and Daytona to slow them down because insurance companies were starting to refuse to cover them above a certain speed.
Believe it or not insurance companies are not mystery entities with unlimited funds. There are some events they just don't cover. At some point the participant has to accept ALL of the risk or not participate.

Contract employees are liable for their own benefits and to pay their own taxes so you just answered yourself.

Requiring an appropriate medical coverage before letting a boxer in a ring would be another reasonable expectation. As some boxers are just punching bags getting sh1t for their fights, I would expect promoters to be responsible for such coverage.

I do not think there is a single person on this forum who does not see this as a tragedy.
I think that placing the blame on anyone outside of bad luck,is just crazy.
I have watched this fight numerous times and like the Du Ku Kim fight I never would of
thought what the aftermath would of been.
I believe that the promoter,the ringside doctor and all seemed to of followed what they thought
was the correct protocol.The only person I see that could of taken any responsobility was Abdusalamov's
corner.When Magomed stated "something don't feel right" they took a portion of the responsobility by
not stopping the fight themselves.
To blame everyone else is wrong.Klitschko's were not in the corner.They were not the ref.They were not the doctor.
It is just a tragedy.But I do not see anyone at fault beside the fighter and his own corner.

In a large city with limited ambulances it can also be argued that having an ambulance at every sporting event with the possibility of injuries is not a reasonable expectation.

Personally, I would expect an ambulance to be at every boxing event ever held anywhere in the universe but if they aren't available then I guess I'm out of luck.
