Pacquiao being sued.

I like most people read this story the other day. Wasn't until I read a bit on the Sky Sports app that I seen it was two 'fans' who are suing him 'on behalf of all persons who purchased tickets; purchased the pay-per-view event; or who wagered money on the event'. They are seeking 5mil! Are these two jokers for real? And IF they win shall they be distributing their payout amongst the fans they claim to represent :roll:. I know in America you could probably be sued for farting in a lift but this is just ridiculous. Pair of desperate chancers!

It's a class action lawsuit in which you take them to court for everybody involved. About once a year I will get a cheque for about 82 cents because of something daft that I didn't even notice.

If they win then everyone who bought the ppv will get a few cents back.

To be fair, Pacquiao has brought this on himself going on the evidence out there at the minute.

He stated that he had a shoulder injury but allegedly never declared it on a legal document. It doesn't really matter if this is really a fair way to declare injuries as it could provide information to the opponent, it is legally required.

If he had have accepted his defeat like a man, he wouldn't be in this position.

The plaintiffs are claiming that they relied on misrepresentations when betting since the injury wasn't disclosed. My posts from the CS:
Loads of fighters have fought with injuries. If they didn't disclose this on such a form prior to the bout out of worry that their fight would be canceled and/or their opponents would be find out about their weakness should they all face jail time, large fines, and sizeable suspensions too? And how much time and money would this cost and would it be positive for the sport if things like this were constantly being reported?

I also have little doubt that some of the people in this thread would be accusing Pacquiao of ducking if he had disclosed the injury and the fight was thereby canceled or postponed, or at least scream "excuse!" if the fight wasn't canceled but word got out about the injury ahead of time.
What if a fighter develops depression before a fight, it hampers their preparation, and they don't inform anyone of that until later? Sue them too since it could've impacted the outcome? What if losing a close relative has the same impact on another fighter and this is only discovered by bettors after the bout? How about a pre-fight loss of motivation? How about acting much more confident in the public build-up to a fight than they really were? Are all these instances of misrepresentation that hurt certain bettors?

Since a major portion of betting is over/under, should a fighter also be sued if they didn't beat their opponent as quickly as expected and they waited until after the fight to reveal an injury that could help explain why they didn't win earlier? Related to that, how about if a fighter who typically stops their opponents early decides ahead of time that they're going to try to get rounds in, but only admit this post-fight when bettors who expected them to be more aggressive have lost out?

And how far back should the legal action go? Should fighters who haven't competed for 30 years be sued if they didn't disclose this type of info until after a fight? Would a surge in this type of litigation help the sport?

But they wouldn't have had the information before the fight anyway. The people suing I believe are fans, not people who would have had inside knowledge.

So regardless of it being declared it's a stupid lawsuit by the fans. Te Nevada commission on the other hand have a case

I don't agree with them taking out the lawsuit at all but if he has not declared what he legally should then they do have a case.

I'm guessing the majority of fighters don't declare their injuries in Nevada but might then have more sense not to blame their defeat solely on that injury.

I'm sure many of us have broken rules/laws but we're not stupid enough to go out shouting about it afterwards expecting no punishment.

The implications for this lawsuit are truly huge and go way beyond boxing if the plaintiffs win. As sport betting is so huge and diverse, it means anyone who bets on a sport and a key player in that sport has an injury that has not been made public knowledge than perhaps "all bets are off". This would make the gambling industry so open to abuse from lawsuits that the entire business would collapse. Gambling is far too big for judges to be allowed to make that kind of ruling, so the suit will fail. As a compromise, perhaps Team Pacquiao will be found guilty of perjury or something along those lines.

Yeah they will be opening the proverbial flood gates! Nonetheless it's still a bit of a headache for Pacquiao and his team. I bet he wishes he kept his mouth shut now.
