According to a report by CBS Affiliate KLAS-TV - Manny Pacquiao, Bob Arum, Top Rank Inc., Michael Koncz, Todd Duboef and possible unknown defendants are being named in a lawsuit filed in U.S. District Court in Las Vegas on Tuesday morning.
The lawsuit, filed on behalf of Staphane Vanel and Kami Rahbaran who live in Clark County, is seeking damages because Pacquiao failed to disclose his shoulder injury before Saturday's fight with Floyd Mayweather Jr. They are looking for $5 million in damages.
According to the lawsuit papers - "the plaintiffs relied on misrepresentations and non-disclosures when purchasing tickets or pay-per-view showings and wagering on the Mayweather-Pacquiao fight."
Similar lawsuits are bound to pop up and other plaintiffs may join the lawsuit in Las Vegas. The arena gate generated more than $70 million and a record number of bets were made on the fight.
Pacquiao is already under fire for entering the fight with the pre-existing right shoulder injury and not disclosing that information to the Nevada State Athletic Commission.
The NSAC is going to conduct an investigation as to why Pacquiao and his team failed to disclose the injury on the pre-fight questionnaire that was completed at the weigh-in. The injury was revealed at the post fight press conference following the fight.
Pacquiao, who suffered the injury in early April, is having shoulder surgery to repair a torn rotator cuff. The surgery could keep him out for the rest of the year.

The suit alleges that Pacquiao and his manager Michael Koncz, his promotional company Top Rank, its chairman Bob Arum and its president Todd duBoef, admitted that they knew of his shoulder injury after the fight, but failed to disclose it to the Nevada Athletic Commission as required by law. They also kept it a secret from fans who bought tickets to the fight, purchased the fight on pay-per-view and bet on the fight.
"Defendants prior to and at the time the plaintiffs and the class decided to purchase tickets; purchase pay per view showings or wagered on the event the defendants knew and had full knowledge and information that defendant Pacquiao had been seriously injured and was suffering from a torn rotator cuff," the lawsuit reads. "Defendants further know that such injury would severely affect his performance."
It is estimated that pay-per-view revenues could top $300 million, and wagers in the state of Nevada alone on the fight could surpass $60 million. Ticket revenues from the fight were expected to generate $72 million, though only roughly 500 tickets were sold to the public.
Although Saturday's fight lasted the full 12 rounds, with Mayweather winning by a unanimous decision, the question is whether the fight -- advertised as "The Fight of the Century" -- was properly promoted or whether it was a fair contest from the start. The plaintiffs argue that it was not and violated the Nevada Deceptive Trade Practices Act.
"The allegations in this lawsuit are demonstrably false," said attorney Daniel Petrocelli, who represents Top Rank. "There are documents that explicitly show the medications that Manny was using to treat his shoulder and it was fully disclosed with USADA, which we contracted for this fight."
Petrocelli said that Pacquiao was examined by doctors before the fight and was proved to be physically able, but re-injured his shoulder during the bout. That the public was unaware of Pacquiao's original injury is immaterial, Petrocelli said.
"This is a frivolous lawsuit and we are confident it will be dismissed," he said.

That's an interesting take, and I gave Mayweather the fight, but actually gave Pac the 12th round (but thought I was the only one). Even though Mayweather may have connected a few times in the round, I just can't give a round to a guy who is in full sprint mode away from the other fighter. The whole team deserves to be sued. They withheld information that would have informed a significant part of the betting public not to bet on Pacquiao. If Team FMJ knew about it, the whole event was a complete farce, literally an exhibition disguised as a super fight.
The class action is not inclusive enough and the amount is about $250mil too low.

Hiding an injury happens frequently in boxing. There are many post-fight reports of boxers having fought with an injury, for example when Evader fought with a bad shoulder vs Michael Moorer, and when RJJ had a broken wrist and still beat Talesco.
The afore-mentioned fights were entertaining, though. People wouldn't complain.
Apparently' Mayweather knew about the injury. And he still capitalize on it?! He should have beat the piss out of Manny if he knew about the injury.

What if a fighter develops depression before a fight, it hampers their preparation, and they don't inform anyone of that until later? Sue them too since it could've impacted the outcome? What if losing a close relative has the same impact on another fighter and this is only discovered by bettors after the bout? How about a pre-fight loss of motivation? How about acting much more confident in the public build-up to a fight than they really were? Are all these instances of misrepresentation that hurt certain bettors?
Since a major portion of betting is over/under, should a fighter also be sued if they didn't beat their opponent as quickly as expected and they waited until after the fight to reveal an injury that could help explain why they didn't win earlier? Related to that, how about if a fighter who typically stops their opponents early decides ahead of time that they're going to try to get rounds in, but only admit this post-fight when bettors who expected them to be more aggressive have lost out?
And how far back should the legal action go? Should fighters who haven't competed for 30 years be sued if they didn't disclose this type of info until after a fight? Would a surge in this type of litigation help the sport?

Can someone please explain something to me? Why in the world would a boxer ever admit an injury prior to a fight that would CLEARLY give his opponent an advantage? That would be like telling Floyd "look, my shoulder is junk so if you circle to my right, i won' be able to hit ya. Oh and if you just start banging away at my shoulder or if we clinch a lot, it's gonna hurt like a MF'er."
I can understand the idiots with the civil lawsuits that will be thrown out of court but why is Manny in trouble with Boxing Commission in Nevada? People are always pissed when they lose money, and excuses like Pac's are an avenue to get some back.
If Floyd had mris done he probably has 2 torn cuffs. He has pains too but more mental toughness I guess. Pain isn't a factor when you win.

This is a physical injury that Pac immediately utilized as an excuse post fight. This was a super fight with hundreds of millions spent to view it as well as bet on the outcome. Team Pac also claims that FMJ knew about it. Notice how Senior kept questioning FMJ's lack of activity? Notice how FMJ, when asked when he felt in control of the fight, answers, "from the beginning, first round?"
It is possible, given Team Pac's claims, that FMJ knew that Pac was injured, checked him in the 1st round and decided to stay safe while letting it remain competitive.
The final presser, weighin, glove tapping every round, dry humping prior to 12, and insertion of controversy at the post fight presser all point to a choreographed farce designed to lead to an eventual rematch.
It cost gamblers $$$ and denied ppv buyers the info they needed to make an educated decision. None of which would matter if they were not now attempting to rob people of their hard earned dough a second time by using the same information to rationalize the eventual rematch.
Sue the socks off of the whole production!! Make them admit that this was akin to a professional wrestling event, only less entertaining.

When Manny was interviewed by Kellerman, he said he couldn't hit Floyd because he wouldn't stand still, then it was my shoulder hurt, then I heard something about the wrapping of the hands, then I heard something about Packy only weighing 143 before the weigh-in.
I mean, how much more sore grapes do these people have? The have absolutely zero shame in showing how BUTTHURT they are, I'm really starting to feel sorry for them......................NOT!!
