allegedly Statement on Ricky Burns and Paul Smith

As a consequence of a high court judgement in the allegedly v. Ricky Burns litigation, allegedly’s solicitors lodged a claim with Burns’ Trustee in Bankruptcy in the sum of £447,000 plus interest. Lawyers acting for the Trustee in the bankruptcy of the estate of Mr. Burns have now confirmed that they have withdrawn the appeal lodged by Mr. Burns against the Judgment and Mr Warren is now pursuing the recovery of sums due to him . In the Judgment, the court found in Mr. Warren’s favour that he was owed management commission arising out of Mr. Burns’ contests and was criticised for the manner in which he sought to walk away from his promotional agreement with allegedly Promotions.

In a separate ruling, Paul Smith has today been ordered to pay 100% (£48,000) of Mr. Warren’s costs for including him as a party in a misguided court application. Smith had sought to remove the British Boxing Board Of Control’s jurisdiction over a contractual dispute between himself and Mr. Warren. The dispute is now proceeding under the Board’s rules and regulations.

What does the trustee part mean here? Is it that his assets were basically frozen at that point by the court so he couldn't transfer them out of his name or are they going after the person he transferred the assets to?

Another example of how toothless the bbbc are

Likely a trustee was appointed to freeze his assets and hold them until it can be determined who should get what out of them.

If someone were to go back and "tot-up" how many boxers have come unstuck with allegedly, then I'd imagine they'd end up with a fairly long list. I don't like the idea of any fighter going in gyms for twenty years, having fights, dieting, having all the nervous ups and downs before and after fights to come away potless. Rendall Munroe had the right idea, stay on them bins!

Whatever the rights & wrongs of the case, it seems clear that Burns has been very badly advised on this one.

Is this not something that's written down in black and white somewhere, a copy of which any boxer should have in his house? Not having a go at anybody but it seems like he's just put 48 grand on the back of a horse here - and frankly it might have allegedly been any figure. What is the process of proving costs? Do you have to produce receipts for work carried out - and are these receipts compared with other receipts of other clients/ or similar professionals, to make sure they aren't just randomly, astronomical sums? Generally speaking I mean. Frankly, to me, 50 grand seems a bit OTT for a relatively tiny dispute.

Boxers in general appear to be extremely badly advised.

Maybe it would be better if there was some sort of pool of cash at the BBBOC which would provide free legal advice to licensed boxers.

Couldn't they're new tv backed promoter pick up that bill?

Why put it on the board who would likely gain the money from increased fees (as has happened recently) to small hall promoters who are generally struggling as it is.

I agree - however for 99% of boxers it is a case of "there's a contract, take it or leave it".

It is only the very few like Amir Khan, Joshua and Campbell etc. who have the negotiating power and money to pay for the specialist advice required.

There is also the added disadvantage that it appears that some contracts can be between the boxer as a person and a limited company.

If things go tits up then the boxer is stuffed and can lose all of their own personal money and maybe their house, whereas the company can just go into liquidation without paying its debts and the owner of that company can just walk away.

This is the bit i really don't like either. It seems really wrong that a fighter can be dragged to court, win a case but see the company go to the wall and receive nothing but would be left in the muck if it was the other way around and lose it all.

I'd just get on the blower to Don King and just say "Don, is anything missing from this contract (often it's what's NOT in it than what is in it). Would really appreciate it if you could tell me if I'm open to getting stiffed here."............If I lived in the States I would just do that take him out for a coffee or something. He's allegedly good at this stuff. He'd probably be laughing whilst reading it, generally speaking.

The main problem is that we all enter into contracts without reading and understanding the full details. For example how many people reading this fully understand their house insurance policy. If your house gets burned down tonight are you certain you know what you'd be due. I'll guarantee you it's likely you'll be put up in a hotel, but you'll have to pay for your own meals. The rebuilding work will have to be put out to tender, and you' ll be lucky to be back in your house within a year. And will your furniture and clothes be replaced new for old, or simply the value put in them by the insurer.
Bottom line, everybody must fully understand any contract they sign. Anyone signing with big managers/promoters would be well advised to take a quality solicitor with them.

Trouble is, you're talking about people in the main, who are not very knowledgable, and easily manipulated. Most boxers are hardly from excellent education backgrounds, and are often desperate to start making some proper money, as the sport is not one which you make much in, without having a proper management and promotional team behind you.

His best option IMO is the one that there's no chance of him taking, which is to go back to Warren. Hearn clearly doesn't give a shit about him and is more interested in his other lightweights, if he's going to get a decent fight at home he needs to go elsewhere, in this country there isn't really many other options. In terms of his manager he could go self managed, although I've always got the impression he's happy to let other people deal with stuff like that, could go back to Billy Nelson and have him as trainer and manager.

Like I said, there's no chance of it happening but he'd be better off with them IMO. He didn't fall out with Billy, just chose to try somewhere different and personally I'd consider it going back to the man that took him from domestic gatekeeper to two weight world champion and taking him on as manager too. He doesn't work in the shop anymore and there's a decent number of fighters that are self managed, if he wanted to go down that route he could do, or he could get himself a different manager.

I know there's absolutely no chance of him going back to Fwank after everything that's happened, but he'd be better off with him than Hearn IMO. Won't happen though and if it did it would be as big a shock as Frank Maloney announcing that his cock was to be cut off.

It's pretty mental that in this country you can just wind down a company, and start another one, thereby avoiding paying your creditors - I don't understand how the law is so lax as to allow that to happen - is there no personal liability in these instances?
