It was a WBA decision to have him up in the rankings and promise him a title shot in the first place, which was what lead to the legal wrangling. He should have never been anywhere near a top 10 anytime in the last decade.Like a Boss wrote:You could not possibly be more wrong. U.S. Court issues final decision in favor of Oquendo
Square Ring Promotions and Hitz Boxing announced today that District Court Judge Ronnie Abrams for the United States District Court for the Southern District of New York issued a 41-page final opinion and order in Oquendo vs. Terek Box Event (Case no. 14-cv-9835) awarding Oquendo damages and interest in excess of $800,000 against Chagaev’s promoter, Terek Box Event, and a permanent injunction enjoining Terek from, among other things, “promoting or managing Ruslan Chagaev in any bout for the World Boxing Association (“WBA”) World Heavyweight Championship or in any bout at which his WBA championship would be at stake, other than such a bout between Fres Oquendo and Mr. Chagaev.”
On May 12, 2015, Chagaev participated in a press conference with Francesco Pianeta to announce a bout on July 11, 2015 at the GETEC Arena in Magdeburg, Germany for the WBA World Championship. On May 14, 2015, the Court issued an order for Terek to show cause why it should not be held in contempt of court for violating the Court’s preliminary injunction prohibiting Terek from promoting or managing Chagaev in a WBA title bout other than a rematch with Oquendo. The contempt of court proceedings are scheduled to be heard on June 4, 2015.
“We have provided a copy of the Court’s final decision to the WBA and its counsel and are awaiting the WBA’s public announcement on this matter,” said John Wirt, CEO of Square Ring Promotions. “The U.S. Federal Court has unambiguously spoken and issued a well-reasoned opinion in upholding Oquendo’s contract for a $1 million purse and his right to a rematch with Chagaev, and we are confident that the WBA will do the right thing and respect the Court’s decision on this matter.”
“I’m very happy that we now have a final court decision that shows what we have been telling the world for months,” said Bobby Hitz, President of Hitz Boxing. “Oquendo made sacrifices and went to Grozny when his wife and newborn baby were sick. He performed his end of the deal; now it is time for Chagaev and his promoter to honor the agreement and pay Oquendo his purse and give him the rematch he was promised. The WBA can no longer turn a blind eye and must now step in and bar the Chagaev vs. Pianeta fight.”
“First and foremost, I want to thank God for this great victory in my career through the courts and for finally getting justice,” said Fres Oquendo. “I’ve been hard at work training and getting ready for my rematch for the WBA title. Thanks to everyone and all my fans who have been so supportive of me and my family during all of this. And a very big thank you to my attorneys, Judd Burstein and Peter Schalk for believing in me and winning this case.”
“It’s been 10 years since Fres and I embarked on a journey to win the heavyweight championship of the world,” said Tom Tsatas, Oquendo’s long-time advisor. “We have been laughed at. Cheated. Ripped off. Knocked down. And we are still standing. We finally have people who believed in us, fought for us, and like us, are not quitters but rather champions of what’s right. This is a win for Fres, for the underdog, for the U.S., for the little guy, and for boxing. Never give up no matter who you’re up against. If God is with you, who can be against you?”

The venue and date for the Oquendo fight is undecided. There is a possibility promoter Brian Amatruda could put it on in Melbourne in November or December. while China in January has also been suggested.
Browne was in the US last week and visited the gym in Fort Lauderdale where he will spend time preparing for Oquendo.
“I will have a 10-week camp and spend 3-4 weeks in Florida where I’ll get a different level of sparring,” he said.
“Oquendo’s not a major drawcard and the money won’t be as big as say fighting David Haye. But it isn’t about the money side, I just want the belt. I’ve won it already and not been able to keep it.
“He’s 43 years old and crafty and won’t stand still. But he hasn’t fought in two years and he’s coming off a shoulder injury. There’s a difference between fighting someone else and fighting me who can knock you out with one punch.”
Despite his ordeal, Browne, 37, has remained upbeat and said there was one silver lining.
“Yes, I didn’t have to pay the purse back,” he said. “That was one good thing because I had already started spending some of it. I bought a Commodore for the family.”
Browne's manager Matt Clark, who was in Chechnya with Browne for the Chagaev fight, said the team felt vindicated by the WBA resolution.
"We're not sure how it got into his system while we there - if it was done deliberately (ie he was nobbled) or if he ate contaminated meat. I suppose we'll never know," Clark said.
"But we're happy this has now been settled and Lucas can look forward to fighting for the world title again.

The WBA was hoping Oquendo would die of old age before they gave him the title shot.
I'm glad this deal with Oquendo and the WBA will finally be completed, this business has done nothing but get in the way of some interesting fights.
Nobody............including Browne..............wants to waste their time with Oquendo but somebody has to do it.

Lucas Browne is hoping to spar Shannon Briggs and Antonio Tarver in the lead-up to fighting Fres Oquendo for the vacant WBA title early new year.

Re: Browne-Oquendo negotiations for WBA title fight underway
Q & A with Lucas Browne :
http://www.foxsports.com.au/boxing/boxe ... 7d2b5d2213
GRANTLEE KIEZA: The WBA last week gave you the green light to be world champion again. You must feel vindicated?
LUCAS BROWNE: It’s been a long time coming. It has been a very stressful six months since I knocked out Chagaev only to have the title taken back. The WBA were somewhat on my side. They realised I hadn’t taken anything deliberately. It was still a positive test and I can’t argue with that. It is my responsibility what goes into my mouth and I understand their rules. I just wished it hadn’t happened in the first place.
KIEZA: How do you explain testing positive for Clenbuterol, which is a banned weight-stripping substance?
BROWNE: I’m guessing there must have been something in a steak I ate before the fight over there. The WBA came out last week and said the result was consistent with one small dose of Clenbuterol which means I wasn’t on it.
Five days before the fight I passed a test and I paid to have it done, why would I then take a small dose of something that is not going to help one bit for the fight, makes your heart go three times faster than normal and is then going to get you suspended from the sport? I’m guessing it was in the steak but that’s just speculation.
KIEZA: In the grand scheme of things that’s all behind you, now?
BROWNE: Yes, but I have to beat Fres Oquendo in my next fight to win the vacant title. Really I’m back at square one as a title challenger rather than the champ.
I know it never pays to be too confident in boxing because disaster can strike at any time. But you must fancy your chances against Oquendo? Every big fight he’s had — against Chagaev, Evander Holyfield, David Tua, James Toney and others — he’s come second.
Yes, I’m confident. I feel that it’s certainly an easier fight than someone like David Haye from England. But I’m happy to have an easier fight so to speak to get my title back and then I can go after the big names.
I don’t think I’ve ever seen anyone happier than your mum, Leonie, when you arrived back at Sydney airport with the world championship belt?
Ha. I think she was happier that her photo was going to be in the paper. She sent me a copy of it the other day and said `see, I’m still semi-famous’. Seriously, though, she’s just so happy that things have worked out for me. My father Graeme died suddenly about five years ago so he didn’t get to see my success but Mum is very proud for him too.
KIEZA: Not to get too far ahead, but you must now be eyeing multi-million dollar paydays against the likes of David Haye, Tyson Fury, Wladimir Klitschko and Deontay Wilder?
BROWNE: I’d like to fight all of them, 100 per cent. I’m 37 now I don’t want to be in my 40s and still desperate for a payday. I want to make some money, make some history and then get out. I hope can make some real money and retire from boxing a happy man.
KIEZA: How important is it to fight for the title in Australia?
BROWNE: I would love it. There’s talk of fighting Haye in the UK simply because there would be a lot more money in it because boxing is such a huge sport over there. But I would love to fight Oquendo in Australia and to make some history and get the public involved. I would like my name known for all the good reasons.
KIEZA: You worked as a bouncer for many years. How long since you said “Sorry, Sir, wrong shoes.’’?
BROWNE: Four years.
KIEZA: I’m guessing you don’t miss it?
BROWNE: No. Funny that. I don’t drink and never have. So being around intoxicated people 24/7 is not my thing. Working on doors I had people come at me with broken bottles, chairs. I even got shot at once on a door in Sydney so I’m glad to be right out of that scene now.
