Spence in serious condition
Re: Spence in serious condition
Reports saying he sustained injuries to his head and the brain. He is in critical condition, and either way, I doubt he makes it back in the ring anytime soon withen the next two years. Reports also say DWI is the source of the speeding at late night and what caused the crash. If it happens to be true(which is most likely the case), he’s looking at mandatory jail time.
Re: Spence in serious condition
Ok that is horrible if accurate however we have many conflicting accounts. What are your sources?KingBeR wrote: ↑10 Oct 2019, 18:40 Reports saying he sustained injuries to his head and the brain. I can tell you for certain a first DUI is far from mandatory jail time. Quite the opposite.lazboy wrote: ↑10 Oct 2019, 19:06Ok that is horrible if accurate however we have many conflicting accounts. I was wondering that too. Is not the case in Australia. Obviously wasn't sure about over there (naive of me) however that seems cruel and unusual punishment.Onetimeonly wrote: ↑10 Oct 2019, 19:08I can tell you for certain a first DUI is far from mandatory jail time. Quite the opposite.
Re: Spence in serious condition
Still surprises me why someone would want to spread such disinformation. The internet is a wacky place.

I had one. Probation before judgment, $500 fine, 1 year probation. You'd have to have a serious record or seriously hurt someone to get time on your first. They wouldn't even ask for it here.lazboy wrote: ↑10 Oct 2019, 19:10I was wondering that too. Is not the case in Australia. I'm sure he has some head injuries, past that his post is shit.
Re: Spence in serious condition
Same as here then. Way too excessive then to get a jail term. I remember in America years ago the 3 strikes and mandatory jail. Maybe it was only for New York. Think it was to curb drug use. Even if you got caught with just possession, it was jail after the third strike. Anyway.....yes way to excessive to face mandatory jail for drinking and driving and there's no report of anyone else hurt. Based on that, his whole post loses credibility.Onetimeonly wrote: ↑10 Oct 2019, 19:13I had one. Probation before judgment, $500 fine, 1 year probation. Re: Spence in serious condition
There is some confusion on here about the DUI laws.
Criminal laws are almost always state laws here, so it depends on what Texas’s DUI law states...it won’t necessarily be the same as any other state some of the posters might have experienced.
I prosecute DUI’s in my state...while standard 1st offense DUIs dont get jail time....we do have what we call “aggravators” that includes things like other serious moving violations (such as speeding 25 over) or extremely high BACs that make even first offenses have mandatory jail time.
But, of course the amount of jail time I am talking about is still somewhere between 4-7 days...not a whole lot.

He was likely ejected after just one tumble and had a great landing, maybe on soft dirt/grass.tiny_acres wrote: ↑10 Oct 2019, 21:10 How the hell do you not get even a broken bone in a wreck like that?

I live in Texas and in any state those who can pay substantially higher fines will always have different rules. Also just speculation that he was drunk, though 3am is an educated guess.ldlamb wrote: ↑10 Oct 2019, 20:56 There is some confusion on here about the DUI laws.

Re: Spence in serious condition
The poster who brought it up declared that there would be 'mandatory imprisonment'. You and other posters have cleared this up as there is no such law in isolation. For example, in Australia we have what is coined the cowards punch law - where there is mandatory 10 year imprisonment regardless of your criminal record or other mitigating factors.ldlamb wrote: ↑10 Oct 2019, 20:56 There is some confusion on here about the DUI laws.

Edit:
Err sorry I didn't read that properly. So there are mandatory jail sentencing in your state if certain thresholds are met. Ok, I guess we''ll find out if Spence meet them. From the video footage it looks like his car was flying.

Re: Spence in serious condition
Well, obviously a rich guy can hire enough lawyers and file enough motions and Bring in enough experts that could make winning a trial difficult and make the prosecutor want to make a deal...but I can promise in my courts, the ability to pay a higher fine wouldn’t have anything to do with it.
The maximum fine is only 500 dollars for a first offense...you wouldn’t be able to get a court order for anything higher...and a conviction for any 1st DUI that includes a BAC over. 15 requires 4 days in jail that can’t be probated, suspended or converted to community service no matter how high the fine is.

Re: Spence in serious condition
What state? Still 4 days could come with a suspended sentence? Mine wasn't in tx, md. Here I ran into the back of a uhaul and the cop drove me home. Never drive with a drop in me again.ldlamb wrote: ↑10 Oct 2019, 21:53 Well, obviously a rich guy can hire enough lawyers and file enough motions and Bring in enough experts that could make winning a trial difficult and make the prosecutor want to make a deal...but I can promise in my courts, the ability to pay a higher fine wouldn’t have anything to do with it.

But as you said, we don’t know if Spence was drinking.
I can imagine a scenario where I’d want to fire up my Ferrari (I wish) to high speeds even if I’m sober.

Re: Spence in serious condition
The state is Kentucky,
The 1st offense carries up to 30 days.
A guilty plea in my jurisdiction usually includes a 30 day sentence but with all 30 days suspended.
But the statute lists a few things called “aggravators” and if one of those is present the statute requires 4 days....this is the exact language.
“If any of the aggravating circumstances listed in subsection (11) of this section are present while the person was operating or in physical control of a motor vehicle, the mandatory minimum term of imprisonment shall be four (4) days, which term shall not be suspended, probated, conditionally discharged, or subject to any other form of early release.”

Re: Spence in serious condition
ESPN: Unified welterweight world titlist Errol Spence Jr. was in stable condition Thursday evening at a Dallas hospital after being involved in a serious one-car accident.
"Spence is awake and responding and is listed in stable condition," his representatives said in a statement. "He didn't sustain any broken bones or fractures but does have some facial lacerations. He is expected to make a full recovery."
Amazing. Simply amazing.
