Canelo Sues DAZN, Golden Boy, De La Hoya
Re: Canelo Sues DAZN, Golden Boy, De La Hoya
An interesting note in the lawsuit is that Canelo and his attorneys have never even seen the DAZN contract.
After a cursory reading of the 24 page complaint, It appears to me that the claims involving Golden Boy are much stronger than the ones against DAZN.

Re: Canelo Sues DAZN, Golden Boy, De La Hoya
DAZN has a contract with Golden Boy, which includes stipulations related to Canelo.
Canelo also has a contract with Golden Boy, which includes stipulations related to DAZN.
Canelo's team weren't included in the GBP negotiations with DAZN. His team haven’t seen the contract between DAZN and Golden Boy.
They asked for a copy of that contract from DAZN & GBP, but neither party were willing to provide it.
Apparently, the contract that Canelo has with GBP is inconsistent with Golden Boy's contract with DAZN.
Canelo is aware of the contractual differences based on the reasons DAZN cited for refusing to broadcast his fights, sanction his opponents and pay him the $35m he was supposed to be guaranteed for his next bout.
Some of the terms of the contract have also disclosed by DAZN and GBP representatives during media interviews.
Oscar De La Hoya blames DAZN for Canelo's decision to file a lawsuit against Golden Boy and DAZN, based on his belief about DAZN failing to fulfil it's contractual obligations to GBP.
If Canelo’s legal representatives are correct about their claims regarding the inconsistencies in both contracts, then most of the blame surely lies with Golden Boy, even though the logic DAZN has used to classify “premium” opponents seems wholly unacceptable, hence the justification behind De La Hoya's claim!
There must be some sort of legal precedent that enables Canelo to file a breach of contract against DAZN, even though he doesn’t actually have a contract with that streaming service. His relationship with them is by proxy of his own contract with Golden Boy.

The most likely scenario is an agent and principal relationship (Golden boy and canelo) therefore a contract would exist between Canelo and Dazn.

Read it. Others have and you should too.
Apparently Oscar De La Hoya assumed a personal liability to guarantee all payments to Canelo.
DAZN doesn’t directly pay Canelo’s purses. GBP does.
Canelo has only seen and signed a contract with GBP.
Once you’ve read the 24-page document, quote each sentence I wrote and attempt to undermine it.
I’m genuinely looking forward to your reply.

I really need to see your reply.
Re: Canelo Sues DAZN, Golden Boy, De La Hoya
30. In the early morning hours of October 17, 2018, Alvarez and Golden Boy Promotions executed a contract that gave Golden Boy Promotions the right to arrange and promote Alvarez’ next eleven fights (“the Alvarez Contract” or together with the DAZN Contract, “the Contracts”).
At [35] …Alvarez also signed a Deed acknowledging that Golden Boy Promotion had contracted that his next eleven bouts…would be broadcast by Dazn….
• This signifies to me that Canelo gave Golden boy either express or implied authority to enter him into a contract with Dazn.
• We would need to see what authority Canelo gave Golden boy in this respect. This is not detailed.
• We would need to see what the Deed canelo himself signed says, also. This is not detailed.
• Bear in mind this is only Canelo’s grievances, the other side(s) will have a lot more to say.
To me, the most likely scenario is that Canelo gave Golden Boy authority to sign him to Dazn, notwithstanding a personal guarantee from Oscar. Therefore he could claim money from Dazn, and Golden boy.

You’re in the same boat as me, because no one has actually seem DAZN’s contract with GBP (including Canelo himself), so we’re both assuming/guessing Canelo’s legal relationship with DAZN.
And you honestly can’t claim otherwise, because you repeatedly keep using the word “likely”and also provided two “guessed” explanations.

There definitely isn’t a contract between Canelo and DAZN. It doesn’t physically exist.
Golden Boy guaranteed Canelo’s purses, not DAZN.
Read the complaint again, because you’ll definitely realise I’m right about this.
I did say that Canelo probably has a legal relationship (or a theoretical contract, based on legal precedents) with DAZN, by proxy of his own contract with Golden Boy, which legally justifies Canelo’s breach of contract lawsuit against DAZN.
Anyway, you’ve clearly failed to highlight any flaws with my post you aggressively criticised, because you couldn’t quote a single sentence that you disagreed with.
So don’t you think you owe me an apology?

You didn’t quote the entirety of my post or even the paragraph that provided context to that sentence.lazboy wrote: ↑11 Sep 2020, 19:40Even after all that you don't get it. There definitely isn’t a contract between Canelo and DAZN.
There isn’t a physical contract between Canelo and DAZN.
He didn’t have an agreement directly with DAZN to read and sign.
Canelo’s 24-page complaint even acknowledges this.
There isn’t even a verbal contract either, since Canelo and his team never met or negotiated with DAZN’s representatives.
There’s obviously some sort of legal justification for Canelo to file a breach of contract lawsuit against DAZN though, but we both don’t precisely know that reason.
And I’ve already stated this multiple times, but you can’t debate honestly, can you?
Re: Canelo Sues DAZN, Golden Boy, De La Hoya
The likely scenario, and alluded to in the paragraphs I quoted, is Canelo gave Oscar authority to enter into a contract on his behalf. Therefore there is a direct contract with Canelo and Dazn, something which he seemingly ratified in his subsequent deed at [35].

Re: Canelo Sues DAZN, Golden Boy, De La Hoya
Do you know what “by proxy means”?
I’ve posted that phrase numerous times in this thread.
It doesn’t mean “direct”.
And Canelo doesn’t have a “direct” contract with DAZN, because a physical contract between himself and DAZN himself doesn’t exist. He didn’t have anything to read or sign. And he didn’t verbally negotiate contractual terms and agree it either in front of DAZN’s representatives.
Also, read the purpose of that deed again.
Once you’ve done that, quote it to the forum and then quote your interpretation of it detailed in your previous post.
Canelo probably has a legal relationship with DAZN, by proxy of his own contract with Golden Boy, which legally justifies Canelo’s breach of contract lawsuit against DAZN.
Read that last paragraph again, when you’ve gained an understanding of the phrase “by proxy”.
Once you’ve done that, issue me with an apology.

When a principal uses an agent,(whom they have given authority to)and the agent contracts with a Third party on the principals behalf, that creates a contract between the Principal and the Third party i.e. Canelo and Dazn. People do this all the time - think of renting out a house with a rental agent.
That's the simple concept I'm trying to explain. I don't think you were aware that this could create a direct contract with the principal as you explained numerous times there was no contract between Dazn and Canelo. I've offered my explanation which I think is more plausible than yours.
However, I'm happy for you to believe there is no contract between Canelo and Dazn, for unexplained reasons. You can run that case with Jesse Vargas as you both get paid the big bucks.
Meanwhile, I'm not being paid any money nor am I proving any professional advice. I'm merely stating my very casual opinion. Your behavior on the other hand is troubling. I feel it is dangerous when you say things like: "Dazn has no contract with Canelo". Like you are certain of this. When a) you don't know that b) you're asserting a fact c) you lack the fundamental understanding of principal and agent, which may be a likely scenario to consider.
It again goes back to the "loudest one in the room" concept; whereby you don't have the substance to back up what you are saying yet you are the most vocal. Instead of trying to impress Boxrec, actually do something and get a qualification so you won't need to pretend.
