SCOTT HARRISON TICKET REFUNDS

Now that it has been announced that scott harrison has finally pulled out and the main event has been officially cancelled (not to mention matt skelton pulling out last week, tony oakey v peter oboh and tony docherty v kell brook fights being scrapped) can ticketholders finally get there money back? Or will there be some loophole to refuse refunds. The tickets clearly have the world championship boxing written on them. So are they going to say khan and frenchman is a genuine "world championship boxing match"? Any ideas?

Well, according to the schedule, its Wayne Alexander vs Serge Vigne for the WBU Middleweight Title.

So my guess is that this fight is the 'World Championship' part....

I doubt Alexander is the best in Shepherds Bush, let alone the world!...

Well this fight was originally scheduled as an 8 rounder. I don't know whether it has been upgraded to a 12 rd WBU LM title fight, which it states in the boxrec schedule. The plot thickens with this shambolic fight card.

It is clearly a material change in the terms of the contract, allowing either party to repudiate.

If you contact SN for a refund, they will probably try and fob you off, but if you persevere you will get a refund.

This is the biggest boxing let down in a long, long while - A greatly anticipated night of boxing has turned into a right rubbish of a night - I knew Scott Harrison wasnt fit enough to fight and all along I had my doubts about him - I suppose most of us will still watch but the expectation and enthusiasm has has unfortunately dissapeared - Hopefully Khan will put in a good performance and save the night to some extent - Anyone wanting a refund to my mind has a good arguement for getting it.

Not quite correct Loynsey a party to a contract cannot repudiate. If one of the parties fail to carry out a term of the contract the other party can claim that the offending party has repudiated the contract, accept the repudiation and deem the contract ended/breached and claim damages.

The correct approach would be under the Misrepresentation Act 1967. If a party is induced into entering a contract by way of 1) a fraudulent misrepresentation or 2) a negligent misrepresentation or 3) a wholly innocent misrepresentation then the injured party is entitled to rescind the contract and claim damages in the event of fraudulent or negligent misrepresentation or in the case of wholly innocent misrepresentation entitled to rescind only, unless rescission is impossible, in which case the court would award damages.

Rescision means that the parties must be returned to the position that they were in before the contract was entered into. i.e you gets yer cash back.

Bear in mind that any Cause of Action in contract with a value of less than £5,000 is a small claim and even if you lose you don't have to pay the other parties costs. So, if you commence an Action for less than £5,000 and handle it yourself, which simply means sitting round a table with a District Judge and stating your case just as if you were telling your mates in the pub it will only cost you the issue fee, which you can get back if you win.

The other side will usually have to employ a solicitor, usually a few hundred quid just to talk to and another few hundred for them to go to Court and they can't get their money back even if they win, so usually the party sued pays up, its cheaper.
