Penn had a history of problems with officials. In 1978 he was reprimanded by the Nevada State Athletic Commission (NSAC) after he incredibly announced to reporters after his bout with Rudy Barro that he had been shot in the stomach a week before the bout.

More disgusting, however, was his actions in 1980 after a bout with Robby Epps in Las Vegas. After the referee disqualified him, he attacked referee Buddy Basilico and struck him in the groin. Basilico, then in his 60's foguht back and spectators rushed the ring to help Basilico. The NSAC suspended Basilico and suspended Penn.
