Frush had to make 126 lbs at ringside and did not move the beam while Kilbane fought at catchweights. His handlers said he weighed 128. Frush down in the sixth and three times in the seventh.

A few days later Frush issued a statement claiming the Featherweight Title anyway, despite his loss. He claimed he had been fouled several times by Kilbane, including being knocked in the groin by a knee. He had waited until motion pictures of this bout came out, he said, according to some newspapers of the day, so that the public could see for themselves evidence supporting his allegations. [1]
