The Feb. 23, 1931 New York Times reported that Kelly was arrested for manslaughter. While acting as a peace-maker in a Dorchester Street, Boston, lunch room, he hit a customer to quiet him. Delbert Webber had objected to the price of a beef stew and used profane language in front of several women. After a scuffle, Kelly ejected him. Another skirmish occurred in the street when Kelly went out and Webber was hit. Webber died Feb. 22.
