I wouldn't like to be half-blinded over a trivial matter from years past, would anybody? If a man will go to that extent over an issue with a bottle of beer, 12 years ago, is he safe to be on the streets? To most people the answer would be a resounding "no". What if you accidentally spilled his pint or bumped into his car or what have you? Is he going to react rationally or is he going to stick his thumb in your eye?

One thing that will definitely adversly affect sentencing is whether the convicted defendant has recent relevant convictions on his record. The Judge has to consider all of the individual circumstances of the offender and the offence and sentence accordingly.
A first time offender is always likely to get a lesser sentence than a defendant with a propensity for serious violence.
I don't know all of the circumstances of the case (eg whether Fury pleaded guilty or not, and if so at what stage in the proceedings). But if a man gauged my eye out I would expect him to receive a lengthy sentence. It's a disgusting act when viciously done in circumstances where the offender simply wants to prove he is the 'hardest' or to settle a score.
For the people claiming knowledge of crown court sentencing have a look at the relevant sentencing case law and the sentencing guidelines. Section 18 gbh....

Haha some people do make me laugh. Poor little gypsy gets 10 years in jail, its so not fair boo fornicating hoo. But hes a gentleman, but but those other bad men got less time, but but the other guy was a bad man too, So poor little gypsy john should of got a lesser sentance. Gimme a break, the idiot got what he deserved if not for this crime, then for all the other stuff hes no doubt done in his life.
As for the person who said its surprising that he never had more knockouts, the reason for this is because in boxing its a one on one fair contests with rules and he like many other "hard men" find out there not as tough as they think they are.

Well in his fifty odd years on earth this has only happened the once. This is clearly a personal grudge between the two. Is it as bad as what James Dolan got? Terry Dunstan or Big Larry (for the blags, not the ped's). Even Henry Castle got less than half that for his SERIES of attacks on a teenage girl FFS! Find the judgments and sentencing remarks of the judges in each case and then compare and contrast. The Judges have to justify their sentences or at least try. No 2 cases are alike and so it's difficult to compare.
In any event, forgot what others have gotten by way of sentence, do you seriously think that 9 years is too harsh for intentionally gauging out another person's eye??

ultimately he did a really disgusting thing, and now has to pay the price. fair enough. Hes got a history of violence and prob then some. so i wouldnt lose any sleep over it. the furys are all naughty boys i believe.

If someone gouged my kids eye out I think I would want them to receive a sentence fit for the crime, plus the criminal who did it, past history etc. I think 10 years is reasonable for destroying someones life. If this guy lives to 70 hes had no sight for 30 years, so it seems fair that the criminal received 10 years, possible 6 or 7 for good behaviour. People cannot just go around gouging eyes out or making snap violent assaults without receiving a harsh sentence. Look at the guy several years ago who stabbed the guy on the motor way. All he did was make a driving error and it turned out to cost him his life. So the other guy got life which is only 15 years on good behaviour. The crime of eye gouging ? Do you have other examples? There was a bloke down this way who gouged his girlfriend eyes. A throw away the key job.
It's indefensible really, losing your sight is a terrible thing. Even one eye it would almost halve your view of the world and you'd be unable to drive

A Category 1 GBH conviction results in a starting point of 12 years with a range between 9-16 years depending on a variety of factors considered by the judge prior to sentencing.mickey1975 wrote:I am not saying he did not deserve it. No two cases are ever the same... Even if the MO is the same, the defendant's individual circumstances (eg antecedents etc) and whether they pleaded guilty or not will have a material affect on sentencing.
Sentencing really isn't as simple as you are implying in terms of one fixed sentence for all cases.

Slightly returning to the original point of the thread: he is mentioned a lot in the Bartley Gorman book King of the Gypsies as Gorman's natural successor so he was a fairly distinguished bare knuckle man. There is a photo of him in the book and everything, when he was younger, looking quite Tyson-esque in shape as a boxer with a black quiff, not like how he looked in the photoshoots they did with him and Tyson before he went to jail. I read that book a fair few years ago (v bored with self serving hard man books these days) and when I saw Tyson Fury being interviewed as an amatuer in Boxing News I was like, oh yeah? Because I recognised the family name from the book.
I couldn't give a toss about his sentence for gouging somebody's eye out. Anybody who thinks it's too harsh, let somebody gouge YOUR eye out, and then see if you cry and moan if they get too stiff a sentence. As for anybody who thinks he hasn't done it before, that's a joke. Course he's done it before. I had a squaddie mate who would put his thumbs in people's eyes pretty much every time he got into a fight. It was horrible but it would get him the win, which was what he wanted. It takes a certain mentality to do that. I'm sure he's bitten off ears and noses in his time, too. I couldn't care less how long he went down for. The people who are saying Rapists got less. Well that's the issue: the rapists should have got more. But he has ruined and scarred, physically and psychologically, another human being for life, which is why rape is one of the worst crimes.

As for the sentencing? It seems harsh compared to other cases presented in here but instead of not giving John 11 years, it should be a case of the others getting waaaaaaay in excess of 11 years.

In terms of 'catching a break' in this country you would have definitely been much better off being born black than being a traveller Pedigree. In certain walks of life ( my job for example ) it's better to be black than anything else! If you are a black woman? Anyway, I was asked by one of these instructors what I used to do for a living and what jobs I had before getting in the brigade. The most recent one was tarmacing. The instructor looked at me when I told him this, and in front of the rest of the room said with a straight face 'oh so you are a pikey then?'
Bear in mind that this brigade is forever banging on about equalities etc etc etc
Thing is it actually brought a ripple of laughter in the room from other students and trainers!

The point I was making is that there is no criminal offence for 'gouging an eye', its charged as GBH which covers multiple specific actions. I.e in terms of the post above mine, when he talked about similar offences and eye gouging, I was raising the point that a similar offence can be GBH without it involving gouging out someones eye.

My dear sister has worked in a top department store house of frazer for the last 10 years,the place that she works at thinks the world of her yet they dont know shes a romany gypsy ,she often mentions that her work mates take the mic out "gypsys" when they come in the store making racist remarks/jokes also calling them pikeys/gyppos/ thieves etc my sister finds these comments not just hurtful but also comical as she know most of these gypsy familys that come in the store and they are so wealthy they would never need to steal from a shop
My sister is now a manager ,but she would of never had a job there let alone made manager if they knew what her ethnic background was ,surely that cant be right in this day and age can it ?
