Referee Jack Dempsey picked up the count incorrectly, and was two counts behind the time-keeper. Knockdown time-keeper Arthur Donovan signaled Heeney out at Dempsey's count of eight and awarded the bout to Baer. Donovan's verdict, which left Dempsey bewildered, had come after Heeney had been rushed through the ropes by Baer in the third round. Heeney had been waiting to hear "nine" before arising. When he learned he had been counted out, he "protested strenuously," and the crowd "broke into a deafening roar of disapproval" for several minutes before leaving the Garden. New York Times
